1.2  This policy explains how we collect and handle your Personal Information and describes the kinds of Personal Information we collect, use, disclose and our purposes for doing so.

1.3  By providing personal information to us, you consent to our collection, use and disclosure of your personal information in accordance with this Privacy Policy and any other agreement or arrangement between us.

1.4  This policy applies to your use of our Website and Platform as well as your other dealings and engagements with us and sets out how and why we collect your Personal Information during your interactions with us. For the avoidance of doubt, unless stated otherwise, this policy will govern our collection of your Personal Information irrespective of the forum.

2.  Our collection of Personal Information

2.1  We only collect personal information by lawful and fair means. We usually collect and store information in paper, physical and electronic form provided by you in person to us, and when you communicate with us by telephone, email, web-based form, application based form, letter, facsimile or other means, including:

(a) When we provide you with our services via telephone, email, our website, mobile and web applications;

(b) When we provide you with assistance or support for our services;

(c) When you participate in our functions, events, activities or social media pages;

(d) When you request that we provide you with information concerning our services;

(e) When you request us to facilitate your switching to a new Energy retailer;

(f) If you complete any forms requesting information from you, complete any survey or provide feedback to us concerning our services, when you upload documents or information to us (including using the functionality we make available via our mobile and web applications) and/or when you otherwise interact with us through our Platform.

2.2  Where practicable we will only collect information from you personally. However, we may collect personal information about you from third parties (including energy retailers) and/or from publicly available sources of information. We may combine your personal information with information and data that we obtain from your access to and use of our Platform and services, other users and third parties, including energy retailers.

2.3  We may also collect information from your computer automatically when you browse our website, mobile and web applications. This information may include:

(a) the date and time of your visit;

(b) your domain;

(c) locality;

(d) the operating system of your Device;

(e) the server your computer is using to access our Website;

(f) your browser and version number;

(g) search terms you have entered to find our Website or enter on our Website;

(h) pages and links you have accessed both on our Website and on other websites;

(i) the last website you have visited;

(j) the pages of our Website you access;

(k) the IP Address of your Device;

(l) the type of mobile device you use;

(m) your mobile device unique ID;

(n) your mobile operating system,

(o) the type of mobile Internet browser you use, and

(p) unique device identifiers and other diagnostic data.

2.4  Please note that it may be possible for us to identify you from information collected automatically from your visit(s) to our Platform. If you have registered an account with us, we will be able to identify you through your user name and password when you log into our website or any applications. Further, if you access our Platform via links in an email we have sent you, we will be able to identify you.

2.5  We may use statistical analytics software tools such as Google Analytics and software known as cookies which transmit data to third party servers located overseas including in the United States of America. Please refer to the section of this privacy policy below for further information on how we use cookies.

2.6  If you do not wish to grant us the right to use cookies to gather information about you while you are using our Website, then you may elect to set your browser settings to disable cookies. This may cause parts of our Website to not function properly.

3.  Why we collect and use your Personal Information

3.1  We collect and use your Personal Information so that we can provide you with services and better your experience with us. We only collect Personal Information if it is reasonably necessary for us to carry out our functions and activities.

3.2  The purpose for which we collect and hold your Personal Information include:

(a) to operate our business and to provide the Platform, including to maintain the website and mobile application through which the Platform and Services are provided, and to communicate with you in relation to the website and mobile application, such as to provide you with notices regarding changes to our terms of use and/or this privacy policy, and to enforce our terms of use, and to develop and to improve the website and mobile application.

(b) to share information with our related bodies corporate and other members of the group of companies that includes us.

(c) to provide and maintain our Service, including monitoring the usage of our Service.

(d) to manage your Account: to manage your registration as a user of the Service. The Personal Data you provide can give you access to different functionalities of the Service that are available to you as a registered user.

(e) to facilitate a Switch of Energy Retailer, by collecting and then disclosing your Personal information to an energy retailer for an application for an Energy Product as requested by you.

(f) to contact you: To contact you by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application’s push notifications regarding updates or informative communications related to the functionalities, services, including the security updates, when necessary or reasonable for their implementation.

(g) for direct marketing purposes as set out below.

(h) to manage your requests: To attend and manage your requests to us.

(i) to manage our Platform operated in conjunction with our business, including analysing data collected from our Platform concerning Platform visits and activities of users on our Platform. This helps us run our Platform more efficiently and give you a better experience online. We use information from third party services such as Google Analytics to help further improve your experience in using our Platform.

(j) for record-keeping and administrative purposes, and to consider applications for employment with us.

(k) for fraud, loss and other crime prevention purposes.

(l) for business transfers: We may use your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by us about our Service users is among the assets transferred.

(m) for other purposes: We may use your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, marketing and your experience.

(n) to comply with laws, regulators, court orders and other legal obligations, or pursuant to legal processes.

3.3  Consequences of choosing not to provide Personal Information

Where it is lawful and reasonable for you to do so, you have the right to deal with us on an anonymous or pseudonymous basis. As permitted by law, and subject to the following, we will give you the option of not identifying yourself or of using a pseudonym, when you deal with us.

However, if you choose to interact with us in an anonymous or pseudonymous fashion, or you if  you choose not to provide us with Personal Information, then we may be unable to do business with you or to provide the products or services that you request.

Further, we reserve the right to verify your identity in certain circumstances. For example, we may need to verify your identity when you request that we provide certain products or services to you, in order to liaise with other service providers or energy retailers, and in order to comply with our statutory and regulatory obligations.

Additionally, when you request access to or correction of personal information that we hold about you, or when you wish to make a complaint regarding how we have handled your personal information, we reserve the right to verify your identity and contact details in order to enable you to access and/or correct personal information that we hold about you, or to investigate and to deal with your complaint.

We may create de-identified or anonymous data from personal information by removing data components (such as your name and email address) that makes information personally identifiable to you, or through obfuscation or other means. Our use of de-identified or anonymised data is not subject to this privacy policy.

4.  What kinds of Personal Information we collect

4.1  The kinds of Personal Information we collect will depend on the type of interaction you have with us. Generally, the kinds of Personal Information we collect may include:

(a) your name, address (postal and residential), email address, telephone number(s), as well as other information that may be used to identify you;

(b) information about your energy (electricity ) consumption.

(c) your individual preferences in respect of the services we provide you;

(d) details of your device you have used to access any part of our Platform, including your device identity and type, your IP address, geo-location information, page view statistics, advertising data and standard web log information;

(e) demographic information;

(f) details as to whether you have taken up any products or offerings of Energy Retailers and Energy Products we have ranked for you;

(g) whether you have a connection with others whose personal information we may collect or hold;

(h) what, how and when you have dealt with us;

(i) any stated preferences for our services you have provided to us; and

(j) in the course of providing you with professional services, we may also have a need to collect additional Personal Information (for instance, financial details or credit information).

4.2  Information collected when requesting switching Energy Retailer

Where you request us to facilitate your switching to a new Energy Retailer using the functionality (if any) made available to you, we will request further information from you. With your consent, the kinds of additional Personal Information we collect for this purpose may include:

(a) a medical devices declaration;

(b) information that can prove your identification (such as copies of your driver’s licence, Medicare card and/or passport).

5.  Disclosure of Personal Information to third parties

5.1  We may disclose Personal Information collected from you to third parties but only on an as-needs basis and only to fulfil one or more of the purposes for which we collected the information, any secondary purpose related to the primary purpose(s) of collection, and otherwise as required or authorised by law:

(a) to our related entities, third party suppliers, consultants, employees, agents, contractors, sponsors, government agencies or other third parties to satisfy the purposes for which the information was collected for (as outlined in this policy) or for another purpose if that other purpose is closely related to the primary purpose of collection and an individual would reasonably expect us to disclose the information for that secondary purpose;

(b) when you authorised us to disclose your information to the Energy retailer you wish to switch to;

(c) when your authorised representative contact us in connection with providing you with services;

(d) we may use and disclose personal information in order to establish or to exercise our legal rights, to enforce our contractual rights (including under our terms of use and other contracts or other agreements) or if we believe that such disclosure is necessary to investigate, prevent, or to take other action regarding actual or suspected illegal or fraudulent activities or potential threats to the physical safety or well-being of any person;

(e) we may disclose some or all of your personal information to our professional advisers (including to our lawyers and accountants, our insurers and our auditors, for the purpose of our advisers, insurers and/or auditors completing their obligations owed to us;

(f) to any other person, with your consent (express or implied); and

(g) to any person to whom our assets or business (or any part thereof) is transferred to.

5.2  In addition to the above, we will disclose your Personal Information if we believe (in good faith) that we are required to do so under law or if the disclosure is made in connection with either the normal operation of our business in a way that you might reasonably expect, for example to process an insurance claim, or if such disclosure is incidental or ancillary to IT services being provided to our business, or in connection with any insurance or warranty claim or for the resolution of any dispute that arises between you and us. This disclosure may involve your Personal Information being transmitted overseas.

5.3  We may also disclose your Personal Information if you choose to participate in online or “app” based service offerings whereby your Personal Information may be disclosed to and stored in software which is operated by a third party intermediary as part of your dealings with us. Personal Information disclosed in this may be transmitted offshore, including to the United States of America. When you provide your personal information to us, you consent to the disclosure of your personal information outside of Australia and acknowledge that we are not required to ensure that the overseas recipients treat that personal information in compliance with Privacy Legislation. We will, however, take reasonable steps to ensure any overseas recipient we deal with personal information in a manner consistent with the APPs.

5.4  We may also engage third party service providers (including cloud providers and website hosting providers) that provide some or all of their services to us from location(s) outside Australia. If we do so, we will take reasonable steps to ensure that such service providers deal with the personal information to which they have access in a manner consistent with this privacy policy.

5.5  If you communicate with us via email, through a social network service or through some other electronic process, the communication may be routed through servers that are located outside Australia and, in relation to a message sent to us through a social network service (such as Twitter or Facebook), the social network provider and its partners may collect, hold and process personal information in a jurisdiction outside Australia.

5.6  In the event of a restructure or sale of our business (or part of our business), we may disclose Personal Information to an actual or potential buyer without your consent subject to compliance with the Privacy Legislation. If we sell the business and the sale is structured as a share sale, you acknowledge that this will not constitute the “transfer” of Personal Information.

5.7  We will not sell, trade or rent your Personal Information to any third parties for marketing purposes without your consent.

6.   Collecting Personal Information of Children

The Joulius Service is not directed to individuals under 18. We do not knowingly collect personal information from children under 18. If we become aware that a child under 18 has provided us with personal information, we will take steps to delete such information. If you become aware that a child has provided us with personal information, please contact our support services.

7.  Links to Other Websites

Our Service may contain links to other websites that are not operated by us. If you click on a third party link, you will be directed to that third party’s website. We strongly advise you to review the Privacy Policy of every website you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party websites or services.

8.  How we use Personal Information for direct marketing

(a) We may contact you from time to time to inform you about existing and new services that we feel you may be interested in.

(b) We will ensure that any e-mail that you are sent by us as direct marketing complies with the Spam Act 2003 (Cth) and contain an “unsubscribe” option so that you can remove yourself from any further marketing communications.

(c) You can also call or write to us to request that your details be removed from our direct marketing list. We will endeavour to remove your details from our direct marketing list within a reasonable time (ordinarily five business days).

(d) Our direct marketing list may be operated by software and servers located overseas and as such your Personal Information may be sent overseas as part of our marketing.

(e) Even after you opt out from receiving direct marketing messages from us, you will continue to receive messages from us regarding your account and our Service.

9.  The storing of your information

9.1  We will take all reasonable steps to keep secure and protect any Personal Information which we hold about you, including:

(a) Securing our physical premises and digital storage media; and

(b) Placing password protection and access control over our information technology systems and databases to limit access and protect electronic information from unauthorised interference, access, modification and disclosure.

9.2  Please note that we cannot eliminate security risks associated with the storage and transmission of personal information (including transmission of information via the Internet).

10.  How long do we keep Personal Information

A user’s account will be deactivated by us after a sufficiently long dormant period determined by an absence of response to service messages or where no additional electricity bills have been uploaded to the platform for a period of more than 12 months. Following account deactivation, we will take reasonable steps to destroy or to de-identify your Personal Information, unless we are required or authorised by law to retain such Personal Information for a longer period.

For Personal Information collected via other means, we will take reasonable steps to destroy or to de-identify such Personal Information when we no longer need such Information for the purpose(s) for which it was collected, unless we are required or authorised by law to retain such Personal Information.

11.  How to access or correct your Personal Information or make an enquiry or complaint

If you wish to access or correct the Personal Information we hold about you, or make a complaint, please contact us in writing and will try to resolve your concerns as soon as possible:

Our Platform gives you the ability to access and update certain information about you from within the Platform. You can update some information within your Platform settings and modify content that contains information about you using the editing tools associated with that content.

While we will not charge a fee for making an access or correction request, we reserve the right to charge a reasonable fee in order to cover our costs incurred in providing access to your personal information. All requests for access or correction of Personal Information will be handled in a reasonable period of time following our receipt of your request.

If you wish to have your Personal Information deleted, please contact us using the details above and we will take reasonable steps to delete the information (unless we are obliged to keep it for legal or auditing purposes).

If you have any query or complaint about how we have handled your Personal Information, please contact us, at the details set out in this policy. We will provide you a response within a reasonable period of time following receipt. We reserve the right to verify the identity of the complainant and to seek (where appropriate or reasonable) further information about the circumstances of the complaint. We reserve the right to refuse to investigate or to otherwise deal with a complaint where permitted by law. For example, we may refuse to investigate or to otherwise deal with a complaint if we consider the complaint to be vexatious or frivolous. If you are not satisfied with our determination, then you may escalate the complaint to the Office of the Australian Information Commissioner.

13.  Definitions used in this policy

Device means the device you use to access our Platform.

Energy Products means the products offered by Electricity Retailers which are made available to you as part of the Recommendation Service.

Energy Rates means your then current rate (measured per kWh) charged by your electricity provider for your electricity consumption.

Electricity Retailer means an energy retailer that is accredited with the Australian Energy Regulator in Australia, and their related bodies corporate (as that term is defined in the Corporations Act).

IP Address means a number automatically assigned to your computer and which is required when you are using the internet and which may be able to be used to identify you.

Personal Information has the meaning set out in the Privacy Act.

Platform means Joulius services conducted online at the Website and associated mobile or web application.

Privacy Act means the Privacy Act 1988 (Cth) as amended from time to time.

Privacy Legislation means such laws as may place requirements on the handling of Personal Information under the Privacy Act and the Australian Privacy Principles.

The Joulius Service or Service means the service provided by us to you through the Site, mobile application and web application which comprises monitoring of your electricity consumption and information in relation to Electricity Retailers, their Energy Products and their Energy Rates available to you based on your historical electricity consumption and providing a ranking of possible third-party Electricity Retailers and their Energy Products

You”, “your”, “User” and similar terms means, as the context requires:

(a) You, during your usage of our Website or Platform; and/or

(b) You, during your dealings with us as a customer; and/or

(c) any agent providing your Personal Information to us; and/or

(d) any agent dealing with us on your behalf.

14.  Cookies and Tracking Technologies

Joulius and our third-party partners, such as our advertising and analytics partners use Cookies and similar tracking technologies to track the activity on our Service and store certain information. Google Adwords: As an AdWords customer, the website uses Google conversion tracking by Google on some pages. This means that Google AdWords places a cookie on your computer (“conversion cookie”) if you have accessed our webpage via a Google ad. These cookies become invalid after 30 days. If you visit certain pages on our website and the cookie has not yet expired, we and Google can recognize that someone has clicked on an ad and been directed to our page as a result thereof. Google Remarketing: Moreover, the website uses Google’s Remarketing technology on some pages. With this technology, users who have already visited our web pages and online services and shown in interest in what we have to offer are shown targeted advertising on other websites of the Google Partner network. The ads are displayed through the use of cookies, by means of which the user’s behaviour during his or her visit to the website is analyzed and then used for targeted product recommendations and interest-based advertising.

Thus, Facebook will receive the information from your browser that our web page was accessed from your device.
